Under the APA Act, adjoining lots owned by one landowner, as of May 22, 1973, with a few exceptions, are deemed to have merged into one undivided lot as of that date, even if the lots are described in different deeds, (or different tax map numbers) or were acquired at various times. A sale of any portion of those lots constitutes a subdivision which may require an Agency permit.
